El Paso Judge Orders Release of Illegal Aliens Involved in Border Riot

An El Paso magistrate judge has ordered the release of illegal aliens detained after a border entry riot overwhelmed Texas National Guard troops.

Magistrate Judge Humberto Acosta, in an Easter Sunday teleconference, accused the El Paso District Attorney’s office of unpreparedness.

“All rioting participation cases will be released on their own recognizance,” ruled Acosta. The arrests followed a March 21 incident where illegal aliens tore down border fencing and assaulted National Guard personnel.

Charges include assault on law enforcement. Judge Acosta’s ruling’s scope regarding riot participation charges remains unclear. The DA’s request for a continuance was denied. However, arrested individuals may remain detained if there’s a federal immigration hold. Another hearing for additional defendants is set for Monday.
